ORDER OCH - 2008 - 002

SPECIAL AREA CLOSURE

OCHOCO NATIONAL FOREST

Pursuant to 16 USC 551, 36 CFR§261.50 (a) and (b), the following special restrictions and prohibitions are established within the specific area on the Ochoco National Forest, in the State of Oregon, contained within the boundary lines described as follows and depicted on the attached map, hereby incorporated in this Order as Page 3 of 3.

·· Beginning at the northern intersection of Forest Road 22 and the private property line near Badger Creek, thence following Forest Road 22 in a clockwise direction to its intersection with Forest Road 2210, thence northerly along Forest Road 2210 to it's intersection with the private property line north of Wildwood Campground, thence continuing in a clockwise direction along the private property / Forest boundary line to the beginning.

PROHIBITIONS

It is prohibited to go into or be upon any of the above described lands which are closed for the protection of public health and safety, including all National Forest System roads and trails therein. 36 CFR § 261.53(e)

Being on a forest system road. 36 CFR § 261.54(e)

This restriction is in addition to those prohibitions enumerated in Subpart A of 36CFR§261 and any other special restrictions pertaining to the described lands.

EXEMPTIONS

Pursuant to 36 CFR§261.50(e), the following persons are exempt from this order:

·1. Personnel with written authorization by a Forest Officer, which specifically authorizes the otherwise prohibited act. The issuing Officer may include such conditions as are considered necessary for the protection of the area, or for the promotion of the health, safety, or welfare of its users.

·2. Any Federal, State, or local Officer in the performance of an official duty.

·3. Persons or their invitees who live or own property within the closure area, and permitees who have a legitimate need to access their permitted allotment.

·4. Members of the public staying within the boundary of Walton Lake Developed Recreation Area.

This closure is enacted due to firefighting activities taking place within the closure area, the limited access to privately owned land in proximity to the fire area, and for the protection of public and employee safety.

This Order becomes effective at 10:00 AM, August 17th, 2008, and will remain in force until rescinded.

VIOLATION OF THESE PROHIBITIONS IS PUNISHABLE AS A CLASS B MISDEMEANOR, BY A FINE OF NOT MORE THAN $5,000 FOR AN INDIVIDUAL OR $10,000 FOR A LEGAL ENTITY OTHER THAN AN INDIVIDUAL, OR IMPRISONMENT FOR NOT MORE THAN SIX (6) MONTHS, OR BOTH. TITLE 16 USC, SECTION 551; TITLE 18 USC, SECTION 3551.
